In the Commonwealth of Virginia, the executor of an estate is required to file an inventory and various accountings on the assets of an estate. If the trustee fails to do these things in a timely manner, the Virginia Commissioner of Accounts is compelled to take action. The Commissioner will typically issue a summons requiring the trustee to comply with the requirements within thirty days. If the trustee fails to conform, he or she may be required to appear in a Virginia court of law to demonstrate cause. Ignoring this summons can result in fines and removal of the trustee’s status as the estate’s or trust’s fiduciary. However, once the account is filed by the trustee and certified by the Commissioner of Accounts, it is presumed to be correct and accurate. In the event that an interested party doesn’t agree with the certification, he or she can file a suit to Surcharge and Falsify the account.
